Procedure for Employment to Legally Work in the UK
Although applicants from the new Accession States (Poland, Lithuania, Estonia, Latvia, Slovenia, Slovakia, Hungary, Czech Republic) are legally allowed to work in the UK, there are still specific forms and Home Office documents that need to be completed for them to be allowed to legally work. The procedure is detailed below:
-
Verification and copy is taken of the document showing the holder is a national from the EEA country this is usually in the form of an identity card, passport or a residence permit, a member of the Mploy team signs the documents to verify the likeness and authenticity.
-
The applicant from the EEA accession state is given a WRS Home Office form to complete and is asked to sign them to state awareness that it is necessary to complete and forward it to the Home Office to be registered under this scheme.
-
Mploy complete the section for the UK employer with all the relevant details along with a letter from an Mploy Director to the Home Office confirming when and where the accession state worker is currently working.
-
The accession state applicant signs a form confirming that Mploy have given them a WRS application form, a letter confirming where they are working for Mploy and that they have been made fully aware of the necessity to apply for a WRS card within 30 days of starting employment. If no confirmation is recieved from the Home Office by Mploy within 30 days then the workers contract will be terminated immediately.
-
The completed forms are forwarded to the Home Office and within 30 days the Home Office will send to Mploy confirmation that the applicant has been registered on the Accession State Workers Registration Scheme and is authorised to work for Mploy. Also enclosed will be the accession state workers certificate whichi Mploy will forward on to the applicant.
This process may be subject to change dependant on Home office processes. If the worker is on a temporary to permanent contract then on transfer of employment from the agency (Mploy) to the client a new WRS form must be completed with the new employers details, this is at no extra cost to the applicant. The Home Office will then send new certificates to both the accession state worker and the employer. |
